Terms and Conditions

These Terms and Conditions (the “Terms”) govern access to and use of Piracity, a digital urban treasure hunt that takes place outdoors, in the real world, guided by a smartphone. By using Piracity you fully accept these Terms. If you do not accept them, do not use the service.

Informational document in preliminary version. It does not constitute legal advice: the final version will be validated by a lawyer before the commercial launch.

1. Subject of the service

Piracity is a digital urban treasure hunt experience: outdoor routes in real public places, guided through a smartphone with a map, compass and digital clues. The game takes place in the physical world and requires moving on foot through the urban space.

The smartphone is a support tool: the adventure happens in the real environment around you. Piracity does not organise on-site events nor provide guides, and does not manage, control or supervise the places indicated in the routes.

2. Acceptance and changes to the Terms

By creating an account or using the service you declare that you have read and accepted these Terms and the Privacy Policy.

We may update the Terms at any time. Changes take effect upon publication on this page; continued use of the service after publication constitutes acceptance of the changes.

3. Account, age and minors

An account is required in order to play. You undertake to provide truthful information and to keep your credentials confidential; you are responsible for all activity carried out through your account.

The service is intended for adults. Minors may take part exclusively under the responsibility, supervision and constant presence of a parent or adult guardian, who is fully accountable for their safety and conduct during the game.

4. Purchases, prices and validity

Some maps are paid. Prices are stated in euros and inclusive of applicable taxes. Payments are handled by the third-party provider Stripe: Piracity does not store your full card details.

Each map may have a validity window indicated at the time of purchase, within which the content may be enjoyed. Access to the purchased digital content is made available immediately.

Right of withdrawal: as this concerns digital content supplied on a non-tangible medium, by purchasing and starting to access the content you expressly request its immediate performance and acknowledge that you lose the right of withdrawal pursuant to art. 59 of the Italian Consumer Code. Any refunds are granted within the limits of the law and in accordance with our policies.

5. Safety, risks and participant's responsibility

Piracity is played outdoors, in the real world. The participant is solely and exclusively responsible for their own safety, their own physical wellbeing and their own conduct throughout the entire game experience.

During the game you undertake to: always pay attention to your surroundings (traffic, vehicles, people, obstacles, differences in elevation, ground and weather conditions); comply with the highway code and every local law or regulation; not enter private, dangerous, restricted or prohibited areas; not climb over fences nor trespass on others' property; not use the service while driving a vehicle, cycling or carrying out activities that require attention; honestly assess your physical condition and your limits.

You play at your own risk. To the extent permitted by law, Piracity is not liable for accidents, injuries, personal harm, sudden illness, death, damage to your own property or that of third parties, theft, loss, disputes or conflicts with third parties, nor for any harmful consequence occurring during or in connection with the game.

The places indicated in the routes are real public spaces not managed, controlled or supervised by Piracity: we do not guarantee their accessibility, safety, fitness for use or related conditions, which may change over time.

Parents and guardians are fully and personally responsible for the minors who take part, at all times during the experience.

6. Rules of conduct

You undertake to use Piracity in a lawful, respectful and safe manner: respect the places, the environment, people and the law; do not engage in dangerous, harassing, unlawful or harmful behaviour; do not damage public or private property; do not disturb residents, businesses or others present.

It is forbidden to use the service for unlawful, fraudulent or unauthorised purposes, or in a way that compromises its operation or security.

7. User-generated content (reviews and photos)

By publishing reviews, ratings or photographs (“User Content”) you grant Piracity a non-exclusive, royalty-free, transferable and worldwide licence to use, reproduce, publish and display such content on the public page of the map and for promotional purposes of the service.

You warrant that you hold all necessary rights to the User Content and that it does not infringe the rights of third parties, including copyright, image rights and the privacy of any persons depicted. It is forbidden to upload content that is unlawful, offensive, defamatory, misleading, or that depicts minors without the consent of those holding parental responsibility.

Piracity may at any time moderate, withhold from publication or remove User Content that breaches these Terms or the law.

8. Intellectual property

The contents of the service (editorial maps, texts, clues, graphics, software, trademarks and the Piracity logo) are protected and remain the property of Piracity or of their respective owners. You are granted a personal and non-commercial right of use, limited to enjoying the service.

9. Availability of the service

The service is provided “as is” and “as available”. We may modify, suspend or discontinue it, in whole or in part, even without notice. We do not guarantee that the service will always be available, error-free or uninterrupted.

Operation depends on external factors such as network coverage, the device and the accuracy of the GPS signal, for which Piracity is not responsible.

10. Limitation of liability

To the maximum extent permitted by applicable law, Piracity is not liable for indirect, incidental, special or consequential damages arising from the use or the impossibility of using the service. Where liability cannot be excluded, it is limited to the amount actually paid by the user for the map concerned.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

11. Indemnification

You undertake to indemnify and hold Piracity harmless from any claim, damage, cost or expense (including reasonable legal fees) arising from your use of the service, from the breach of these Terms or of the rights of third parties.

12. Suspension and termination

We may suspend or close your account in the event of a breach of the Terms, unlawful use, or risk to the service or to other users.

13. Governing law and competent court

These Terms are governed by Italian law. For consumers, the court of the place of residence or domicile remains competent, where this is mandatory. The European online dispute resolution (ODR) platform is available.
